1. All bidders are responsible for reading and understanding these Conditions of Sale, as well as any supplemental notices.
2. All bidders, live or silent, must be registered and receive a bidding number.
3. Neither Phillips de Pury & Company, artnet nor Children’s Cancer & Blood Foundation assumes any risk, liability or responsibility for the authenticity, quality or value of items.
4. Estimate of retail values and descriptions of items have been made based on information provided by donors and are deemed reliable.
5. All items are sold “as is.”
6. No buyer’s premium will be charged since this is a charity auction.
7. Purchasers may not request refunds or exchanges from any donor participating in this Auction or Children’s Cancer & Blood Foundation. Each bidder recognizes that neither Phillips de Pury & Company, artnet, Children’s Cancer & Blood Foundation or anyone who assists in the Auctions shall be liable for any occurrence resulting from the use of auctioned items and/or services sold.
8. Children’s Cancer & Blood Foundation reserves the right to withdraw any item before the actual sale. Unless otherwise announced by the auctioneer at the times of sale, all bids are per lot as numbered in the auction catalogue.
9. Final bid does not include shipping/handling. Successful bidders must make delivery arrangements with representatives from the Children’s Cancer & Blood Foundation. Those who choose to pick up their property from Phillips de Pury & Company following the sale must call 24 hours in advance to arrange pick-up. Normal pick-up hours are Monday – Friday, 9:00 a.m. – 5:00 p.m., excepting the hour between 12:00 p.m. and 1:00 p.m.
10. All successful bidders will be notified by mail or email the week after the auction. Methods of Payment are Visa, MasterCard, Discover, American Express, or PayPal. All payments are due immediately upon receipt of invoice.
11. Items may only be purchased by those 18 years old and older.


1. The silent auction will go live online at 3:00 p.m. on Friday, September 5, 2008 and will close on September 16, 2008 at 1:00 pm. Winning bidders will be determined on September 16, 2008 at close of bidding and notified via email or phone. Bidders may also contact artnet client services, at 1 877 388 3256 for information.
2. Bidding for the silent auction items will be accepted at Phillips de Pury & Company during the reception/cocktail party or online through www.artnetonlineauctions.com.
3. Bidders at the cocktail reception are expected to abide by stipulations on Silent Auction bid sheets. Bids that do not match specifications for bidding increments will be disqualified.
4. All starting bids must be greater than or equal to the minimum bid stated on the bid sheet. Each succeeding bid must exceed the required increment as shown on the bid sheet and be in round dollar amounts.
5. If the successful bidder in the Silent Auction placed a bid via Auction bid sheet, artnet will notify him/her via email or telephone by September 17, 2008. If the bidder cannot be reached, Children’s Cancer & Blood Foundation will contact the next highest bidder.
6. If the successful bidder in the Silent Auction placed a bid via online auctions, artnet will notify him/her via email at close of auction on September 16, 2008.
7. In the event of dispute artnet shall have the sole and final discretion to determine the successful bidder.


1. The Live Auction will begin at 7:30 p.m. on September 15, 2008 at Phillips de Pury & Company at 450 West 15 Street New York NY 10011.
2. The highest bidder for any item shall be the purchaser. In the event of any dispute between Live Auction bidders, the auctioneer shall have the sole and final discretion to determine the successful bidder, or to re-offer and resell the article in question.
3. Before removal from the premises, all items must be fully paid.
